The following are misdemeanor hunting offenses that are regularly prosecuted by the Troy Michigan city attorney under the Troy Michigan local ordinances. The numbers listed below are from the Troy Criminal Code:
98.07.01 Hunting. No person shall hunt any animal. A person who violates this section is guilty of a misdemeanor punishable by imprisonment in the county jail for not more than 90 days or by a fine of not more than $500, or both. According to Troy Criminal Code 98.01.02.1 “Hunt” includes seeking, provoking, pursuing, or taking any animal.
Exception. Police officers and animal control officers and any other individuals given written authorization by the police chief or his/her designee who ar in compliance with the City’s policy are authorized to use shell crackers or other noise making devices to control geese and migratory waterfowl.
98.07.02 Trapping. No persons shall trap any animal. A person who violates this section is guilty of a misdemeanor punishable by imprisonment in the county jail for not more than 90 days or by a fine of not more than $500, or both. According to Troy Criminal Code 98.01.02.1 “Trap” includes hunting, confining, taking or entrapping any animal by means of any trap, snare, bait, hook, or other device.
Exceptions: This section shall not apply to the following:
– Persons may trap small rodents such as mice, rats and moles with any type of trap.
– Persons licensed by the State to trap may trap subject to the following:
* Only live traps that cannot kill or injure animals or persons may be used.
* All traps must be permanently marked with the owner’s name and a telephone number where the owner or owner’s agent can be contacted 24 hours a day.
* All traps must be checked at least every 24 hours.
– Persons authorized by State law or regulation may trap animals.
– Police officers and animal control officers are authorized to use traps to capture wild or domestic birds or animals that are running at large or have become a public nuisance.
According to Troy Criminal Code 98.01.03, in addition to the penalties provided above, the court may impose any sanction or remedial measure provided in state law for misdemeanor offenses.
A person who aids, abets, counsels, commands, or procures the commission of the above offenses shall be punished as if that person were the principal. A principal is a person who commits any of the above listed offenses. The word “person” includes any individual, co-partnership, corporation, association, club, joint venture, estate, trust, and any other group or combination acting as a unit, and the individuals constituting such group or unit.
